The Copyright Process

Filing & Diary Number

We draft the application, submit the copies of your work to the Copyright Office, and instantly generate your official Diary Number.

2

Mandatory Waiting Period

By law, there is a 30-day waiting period. The application is kept open so anyone with a valid claim can file an objection.

3

If no objections are filed, the examiner reviews the work. Once approved, the official Extract from the Register of Copyrights (ROC) is issued to you.

Copyright Registration FAQs

What is the difference between a Trademark and a Copyright? +

A Trademark protects your brand identity (Business Name, Logo, Catchphrase) used to sell goods. A Copyright protects original creative content (Software code, Books, Videos, Paintings). A tech startup usually needs both: a Trademark for the App name, and a Copyright for the App's source code.
How long is a Copyright valid? +

In India, for original literary, dramatic, musical, and artistic works, the copyright is valid for the lifetime of the author plus 60 years. For cinematograph films, sound recordings, and photographs, it is 60 years from the date of publication.
Can I copyright an idea? +

No. Copyright law does not protect mere ideas, concepts, or methods. It only protects the tangible expression of that idea. For example, you cannot copyright the "idea" of a food delivery app, but you can copyright the specific source code you wrote for it.
Do I have to send my entire software source code? +

No. To protect trade secrets, the Copyright Office typically only requires the first 10 and last 10 pages of your source code, along with the object code, to establish originality. Our experts will guide you on exactly what to extract.
